These Terms and Conditions ("Terms") govern your access to and use of the Wemart website, mobile application, and all related services (collectively, the "Platform") operated by Wemart ("Wemart", "we", "our", or "us").
By accessing, browsing, registering, placing an order, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please refrain from using our Platform or services.

1. Our Services

Wemart provides retail shopping services through:

• Physical Hypermarket Stores
• Official Website
• Mobile Application
• Home Delivery Services
• Click & Collect (where available)
• Promotional Campaigns and Loyalty Programs

2. Eligibility

You must be at least 18 years of age or have the consent of a parent or legal guardian to use our Platform.
By using our services, you confirm that you have the legal capacity to enter into a binding agreement under applicable laws.

3. Customer Accounts

To access certain features, you may create a customer account.
You agree to:

• Provide accurate and complete information.
• Keep your account credentials confidential.
• Update your information whenever necessary.
• Accept responsibility for all activities carried out through your account.

Wemart reserves the right to suspend or terminate accounts that contain false information or are used fraudulently.

4. Product Information

We strive to ensure that all product descriptions, pricing, images, nutritional information, specifications, weights, and availability are accurate.
However:

• Images are for illustration purposes only.
• Actual packaging may differ from displayed images.
• Fresh produce may naturally vary in size, colour, and weight.
• Certain products may occasionally be unavailable.

Wemart does not guarantee that all information is error-free and reserves the right to correct any inaccuracies without prior notice.

5. Pricing

All prices displayed are in Indian Rupees (INR) and include applicable taxes unless otherwise stated.
Prices may change without prior notice due to:

• Supplier price revisions
• Government tax changes
• Market conditions
• Promotional campaigns

If a pricing error occurs, Wemart reserves the right to cancel or amend the affected order.

6. Orders

Submitting an order does not constitute acceptance.
Orders become confirmed only after:

• Product availability confirmation

Wemart reserves the right to:

• Reject any order
• Cancel duplicate or fraudulent orders
• Limit purchase quantities
• Refuse service where misuse is suspected

If an order is cancelled after payment, the applicable refund will be processed according to our Refund Policy.

7. Payment

Payments may be made using approved payment methods available on the Platform, including online payment gateways, UPI, debit cards, credit cards, wallets, net banking, Cash on Delivery (where available), or other approved methods.
Customers confirm that they are authorized to use the selected payment method.
Wemart is not responsible for payment gateway failures, banking interruptions, or transaction delays beyond our control.

8. Home Delivery

Home delivery is available only within designated service areas.
Delivery estimates are provided for convenience only and may vary due to:

• Traffic congestion
• Public holidays
• High order volumes
• Government restrictions
• Force majeure events
• Third-party logistics delays

Customers must ensure someone is available to receive the order at the provided delivery address.

9. Order Cancellation

Customers may request cancellation before an order enters the processing or dispatch stage.
Once an order has been packed, dispatched, or delivered, cancellation may not be possible.
Wemart reserves the right to cancel any order due to stock shortages, pricing errors, suspected fraud, or circumstances beyond its control.

10. Returns and Refunds

Returns, exchanges, and refunds are governed by Wemart's Return and Refund Policy.
Certain categories—including fresh fruits, vegetables, dairy products, frozen foods, bakery items, personal care products, and other hygiene-sensitive goods—may not be eligible for return unless they are damaged, defective, or incorrectly supplied.
Approved refunds will be processed through the original payment method or another approved method within the applicable processing period.

11. Promotional Offers

Promotions, discounts, loyalty rewards, coupon codes, cashback offers, Buy One Get One (BOGO) offers, and limited-time campaigns are subject to their specific terms and conditions.
Unless expressly stated:

• Offers cannot be combined.
• Offers are subject to stock availability.
• Wemart reserves the right to modify or withdraw any promotion without prior notice.
• Misuse of promotional offers may result in cancellation of orders or suspension of customer accounts.

12. Loyalty Program

Participation in any Wemart loyalty or rewards program is subject to separate program rules.
Reward points, coupons, and promotional credits:

• Have no cash value.
• May expire without prior notice if specified.
• Are non-transferable unless expressly permitted.

13. Intellectual Property

All trademarks, logos, graphics, product photographs, promotional materials, videos, software, content, and designs displayed on the Platform are the exclusive property of Wemart or its licensors.
No content may be copied, reproduced, modified, distributed, or commercially exploited without prior written permission.

14. User Conduct

Customers agree not to:

• Use the Platform for unlawful purposes.
• Submit false or misleading information.
• Attempt unauthorized access to our systems.
• Interfere with Platform operations.
• Upload malicious software or harmful code.
• Abuse promotional offers or referral programs.

Violation of these Terms may result in suspension or permanent termination of access.

15. Third-Party Services

Our Platform may contain links to third-party websites, payment providers, logistics partners, or external services.
Wemart does not control or endorse these services and is not responsible for their content, privacy practices, or performance.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Wemart shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, business interruption, loss of data, or loss of goodwill arising from the use of our Platform or services.
In all cases, Wemart's total liability shall not exceed the amount paid by the customer for the specific order giving rise to the claim.

17. Indemnification

You agree to indemnify and hold harmless Wemart, its directors, employees, affiliates, suppliers, and service providers from any claims, losses, damages, liabilities, costs, or expenses arising from:

• Your breach of these Terms;
• Your misuse of the Platform;
• Your violation of applicable laws; or
• Your infringement of any third-party rights.

18. Force Majeure

Wemart shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including natural disasters, floods, fires, pandemics, strikes, transportation disruptions, internet failures, governmental actions, or other force majeure events.

19. Privacy

Your use of our Platform is also governed by the Wemart Privacy Policy.
By using our services, you consent to the collection, storage, processing, and use of your personal information as described in that policy.

20. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India.
Any dispute arising out of or relating to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts in Ernakulam, Kerala, India, unless otherwise required by applicable law.

21. Amendments

Wemart reserves the right to modify these Terms and Conditions at any time.
Updated Terms will be published on our website and mobile application and shall become effective immediately upon publication unless otherwise specified.
Continued use of our services after such updates constitutes your acceptance of the revised Terms.
